California Medical Marijuana Protection
The great news is that if you are being prosecuted in California for a marijuana related offense you may be protected. This includes simple possession, sales or operation of a marijuana collective or dispensary. Two key laws and several court rulings make up the medical marijuana laws in California.
Proposition 215, known as the Compassionate Use Act was passed in 1996 by California voters. This law made it possible for people to possess marijuana and use marijuana for medical reasons.
Senate Bill 420 also grants implied legal protection to the state’s medicinal marijuana dispensaries, stating, “Qualified patients, persons with valid identification cards, and the designated primary caregivers of qualified patients … who associate within the state of California in order collectively or cooperatively to cultivate marijuana for medical purposes, shall not solely on the basis of that fact be subject to state criminal sanctions.”
Landmark Medical Marijuana Court Rulings – There are many cases in California and these cases continue to shape the landscape of medical marijuana in California. The bottom line is that under People v. Mower (2002) you can have your marijuana case thrown out of court before trial.
