Under California Vehicle Code § 23136, there is a “zero tolerance” policy regarding those who have ANY measurable amount of alcohol in their system. Being under 21 with a BAC of .01% or higher is a civil offense. The underage driver also facing the loss of their driving privileges for 1 year. In addition to the “zero tolerance” DUI laws, those under 21 can also face an infraction under California Vehicle Code § 23140 where their BAC falls between .05% and .07%.
